Article 1 — Identity of the seller

Article 2 — Definitions
Seller: Used Frequency. Buyer: the natural or legal person entering into an agreement with the Seller. Consumer: a Buyer acting for purposes outside their trade, business or profession. Item: the individual second-hand product offered, each of which is a unique specimen. Agreement: the contract of sale between Seller and Buyer.
Article 3 — Applicability
3.1 These terms apply to every offer, order and agreement between the Seller and the Buyer, unless the parties have expressly agreed otherwise in writing.
3.2 The Buyer's own general terms and conditions are expressly rejected.
3.3 If any provision of these terms is void or annulled, the remaining provisions remain in full force, and the void provision is replaced by a valid provision that approximates its purpose as closely as possible.
Article 4 — Offers and formation of the agreement
4.1 All listings are non-binding invitations to treat. Every Item is a single used specimen and is available in a quantity of one.
4.2 Because each Item is unique, an Item may be sold through another sales channel between the moment of listing and the moment of ordering. Where an ordered Item is no longer available, the Seller will inform the Buyer without delay and refund any amount already paid in full.
4.3 The Agreement is formed when the Seller confirms the order by email, not upon placement of the order or upon payment.
4.4 The Seller reserves the right to refuse an order, stating reasons, and to correct manifest errors in prices, specifications or descriptions.
Article 5 — Prices, VAT margin scheme and payment
5.1 All prices are in euros and include VAT where applicable. Shipping costs are stated separately before the order is completed.
5.2 The Seller sells second-hand goods under the Dutch VAT margin scheme (margeregeling). VAT is therefore not stated separately on the invoice and cannot be reclaimed by business Buyers. Where an Item falls outside the margin scheme, this is stated in the listing and VAT is shown separately.
5.3 Payment is due in full before dispatch, by the payment methods offered at checkout, unless collection and payment on site has been agreed.
5.4 Title to the Item passes to the Buyer only upon receipt of payment in full.
Article 6 — Conformity and guarantee
6.1 The Seller guarantees that the Item conforms to the Agreement, to the description in the listing and to the condition grade stated.
6.2 The Items are second-hand. We offer a guarantee period of 30 days from delivery for Consumers. This does not affect the Consumer's rights where the Item does not correspond to what could reasonably be expected of it.
6.3 The guarantee does not cover normal wear, damage caused by improper use, modification or repair by third parties, or defects the Buyer was aware of at the time of purchase because they were stated in the listing.
Article 7 — Liability
7.1 The Seller's liability for damage arising from or in connection with the Agreement is limited to the invoice amount of the Item concerned.
7.2 The Seller is not liable for indirect or consequential loss, including damage to other audio equipment, loss of use, or loss of profit, except where the damage is the result of intent or deliberate recklessness on the part of the Seller.
7.3 The limitations in this Article do not apply to liability arising from death or personal injury, nor where the law does not permit their exclusion.
Article 8 — Complaints and disputes
Complaints should be sent to info@usedfrequency.nl. The Seller will respond substantively within 5 working days.
Article 9 — Force majeure
The Seller is not obliged to fulfil any obligation where prevented from doing so by circumstances beyond its control, including carrier failures, theft, and government measures. Where such a situation lasts longer than 30 days, either party may dissolve the Agreement in writing, without any obligation to pay compensation.
Article 10 — Applicable law and jurisdiction
Dutch law applies to every agreement between the Seller and the Buyer. Disputes are submitted to the competent Dutch court, without prejudice to a Consumer's right to bring proceedings before the court designated by Dutch law.
Article 11 — Intellectual Property rights
All content on the Used Frequency website, including text, photographs, graphics, logos and other original materials, is protected by applicable intellectual property laws.
The Used Frequency name, logo and original content may not be copied, reproduced, distributed or used commercially without our prior written permission.
All third-party brand names, trademarks, logos and product images belong to their respective owners. Their use on our website is solely for the identification and presentation of the products we offer.
